WHO MIGHT NEED A CAPACITY ASSESSMENT?

Under Alberta law, all adults have mental capacity unless otherwise established. Most adults have the capacity to make their own decisions throughout their lives. However, there are some conditions that can impair a person’s ability to make decisions, such as:

  • Cognitive and Developmental disabilities

  • Autism spectrum disorders

  • Attention Deficit Hyperactivity Disorder (ADHD)

  • Fetal Alcohol Spectrum Disorder (FASD)

  • Dementia

  • Brain Injuries

  • Psychiatric Disorders

WHY DO I NEED A CAPACITY ASSESSMENT?

A capacity assessment is a requirement for Adult Guardianship and Trusteeship applications under the Alberta Adult Guardianship and Trusteeship Act.


  • If a situation exists indicating a person's decision-making capacity has deteriorated, and that person's safety is at risk, a capacity assessment may be needed.

  • Persons with long standing developmental disorders who are turning 18 may need an assessment to determine if they require an alternate decision maker.

WHAT IS A CAPACITY ASSESSMENT?

An assessment for Guardianship and or Trusteeship is a multi-step process that provides a formal, objective, and independent assessment of an individual's ability to make decisions about personal or financial matters, or both.
It involves an evaluation of the adult's ability to receive, assimilate, and integrate relevant information; evaluate and weigh benefits and risks; understand the implications of the decision; and then carry out the decision. 
A semi-structured interview is completed with the adult in the setting where they are most comfortable. This is typically in either their home or an office setting. 
Information is collected based on self- report of the adult, administration of measuring tools and tests by the assessor, and collateral information made through observations by caregivers and support persons.

HOW DOES THE PROCESS WORK?

The referral process is very easy; you either email or phone me directly.

An assessment is typically booked within a week or two, as long as the patient medical clearance (I will assist in determining this).

I can meet the patient at their convenience in their own home, or in any supportive living environment.

Evening and Weekend appointments are available.

Following the assessment appointment, the Capacity Assessment Report (CAR) is completed.  

WHAT IF I CAN'T AFFORD THE ASSESSMENT FEE?

Funding is available for those who need it through the Office of the Public Guardian and Trustee. I can connect you with a professional to assist with hardship funding requests.
