PERSONAL DIRECTIVES AND (ENDURING) POWERS OF ATTORNEY
One of the guiding principles when conducting a capacity assessment is to focus on the autonomy of the adult using the least intrusive and least restrictive approach.
This means taking into consideration if an adult can participate in completing a Personal Directive and/or (Enduring) Power of Attorney or recommending that existing documents be activated instead of using a more intrusive measure such as Guardianship and Trusteeship.
